The role of the guardianship court in deciding on withholding treatment (treatments such as artificial feeding) is seen differently by different courts throughout Germany. Some ascribe to the court a review and oversight function, others do not see a role for the court here at all. It remains necessary the court appointed guardian or proxy has do decide.
In this article the authors discuss the implications of a verify function of the court according to the analogous application of § 1904 BGB (guardianship law). Results of a survey among representatives of the German guardianship courts are presented in detail. Pertinent court orders – some of which being previously unreleased – complement the results of the survey in an appendix.
